Terms and Conditions

1. General Provisions

This website presents the products and services of Clara e Costa, Lda. (Técnica Livraria). Certain features may only be available to registered users.

By browsing this website or placing an order, the user accepts these Terms and Conditions in full.

2. Registration and Customer Responsibilities

Access to certain services may require registration at www.tecnicalivraria.com and the provision of accurate and up-to-date identification details.

  • Provide only accurate and complete information;
  • Update the information whenever necessary;
  • Accept responsibility for orders placed using the information provided.

Técnica Livraria shall not be liable for delays or failed deliveries resulting from incorrect or incomplete information. Any costs associated with reshipping or replacing goods shall be borne by the customer.

3. Prices and Conditions of Sale

Account creation and browsing are free of charge and do not entail any obligation to purchase.

  • Prices include VAT at the applicable statutory rate and may be changed without prior notice.
  • “Rare book: Price on request”: means that, where a customer expresses an interest, Técnica Livraria will contact its international suppliers of out-of-print books. The prices quoted may vary depending on the supplier and the condition of the book or magazine.
  • Técnica Livraria reserves the right to cancel orders displaying incorrect or outdated prices.
  • If an item is unavailable, a replacement with an equivalent product may be suggested.

4. Intellectual Property and Content

All website content, including text, images, design and software, is owned by Técnica Livraria or by duly licensed third parties. Product images are for illustrative purposes only and may not exactly represent the characteristics of the current stock or edition.

The website may not be used for unlawful purposes or in any manner that may damage the company’s reputation.

5. Payment Methods

The available payment methods are displayed at checkout and may include, among others, Multibanco reference, MB WAY, credit or debit card, bank transfer and other digital payment solutions. Certain payment methods may be subject to availability and to validation by the relevant payment service provider.

Técnica Livraria does not retain full payment card details; payments are processed through certified secure payment gateways.

6. Order Processing and Delivery

Orders are prepared once payment has been confirmed. The estimated dispatch time is normally 24 to 48 working hours, except in the event of stock shortages or periods of unusually high demand. Delivery normally takes approximately 2 to 3 working days within Portugal and 5 working days for Europe and the rest of the world.

Stock availability is only guaranteed when order processing begins. Where the delivery information provided is incorrect or incomplete, any costs associated with a further delivery attempt shall be borne by the customer.

Técnica Livraria may use different carriers, selecting the one best suited to deliver to the address provided. If the carrier is unable to complete delivery at that address, the customer may be contacted to arrange another attempt or informed that the order has been redirected to a nearby collection point.

Upon delivery, the customer must inspect the condition of the packaging and refuse delivery if it is damaged. Any issue must be reported within a maximum of 1 (one) working day, together with photographic evidence, to [email protected].

7. Cancellations and Returns

The customer may request the cancellation or amendment of an order at any time before dispatch by contacting [email protected].

If an item is out of stock, the customer will be informed and refunded.

The statutory right of withdrawal applicable to online purchases, including the relevant time limits and the conditions governing returns and refunds, is set out in section 11 of these Terms and Conditions.

8. Product Liability

The customer must review the characteristics and descriptions of the products before purchasing. Técnica Livraria shall not be liable for improper use. In the event of a problem, please contact us for assistance.

9. Governing Law

Transactions are governed by Portuguese law. Any matters not expressly covered by these Terms and Conditions shall be governed by the applicable Portuguese legislation, particularly consumer protection legislation.

10. Alternative Consumer Dispute Resolution

Under Portuguese Law No. 144/2015 of 8 September, in the event of a consumer dispute, the consumer may refer the matter to a competent Alternative Consumer Dispute Resolution entity.

Before referring a dispute to an alternative dispute resolution entity, we recommend contacting Técnica Livraria at [email protected], so that we may attempt to resolve the matter directly.

For purchases made online, the competent entity will depend, among other factors, on the consumer’s place of residence and the territorial jurisdiction of each centre.

The consumer may refer the dispute to the following entities:

Referral to an alternative dispute resolution entity does not prevent the consumer from bringing proceedings before the competent courts.

11. Right of Withdrawal

For purchases made online, the consumer has 14 (fourteen) calendar days in which to exercise the right of withdrawal from the contract, without having to provide any reason and without incurring any costs other than those provided for by law.

The withdrawal period begins on the day on which the consumer, or a third party designated by the consumer other than the carrier, acquires physical possession of the product.

Where a single order includes several products delivered separately, the withdrawal period begins on the day on which the consumer acquires physical possession of the final product. Where a product is delivered in several lots or parts, the period begins upon physical possession of the final lot or part.

To exercise this right, the consumer must inform Técnica Livraria of the decision to withdraw from the contract before the withdrawal period expires, by means of an unequivocal statement.

The communication may be sent:

  • by email to [email protected];
  • by post to Avenida Conde de Valbom, 122, 1050-070 Lisbon, Portugal;
  • using the model withdrawal form made available at the end of this section.

Use of the model withdrawal form is not mandatory. The consumer may use any other unequivocal statement communicating the decision to withdraw from the contract. The right of withdrawal is deemed to have been exercised within the applicable period where the communication is sent before the 14-day period expires.

After communicating the decision to withdraw, the consumer has 14 days in which to return or hand over the product to Técnica Livraria.

The product may be returned in person or by post, preferably using a method that provides proof of dispatch, to:

Unless otherwise agreed or where applicable legislation provides otherwise, the direct costs of returning the product shall be borne by the consumer. This does not affect the consumer’s rights where the product is defective or does not conform to the contract.

The consumer may inspect the nature, characteristics and functioning of the product with due care. The consumer may be held liable for any diminished value resulting from handling beyond what would normally be permitted in a retail establishment.

Where the right of withdrawal is exercised, all amounts paid will be reimbursed, including the costs corresponding to the standard delivery method offered by Técnica Livraria.

Any additional costs resulting from the consumer’s choice of a delivery method other than the least expensive standard delivery method offered will not be reimbursed.

Reimbursement will be made no later than 14 days from the date on which Técnica Livraria is informed of the decision to withdraw, using the same means of payment as those used for the original transaction, unless expressly agreed otherwise and without any fees being charged to the consumer.

Técnica Livraria may withhold reimbursement until it has received the returned product or until the consumer provides evidence that the product has been dispatched, whichever occurs first.

Unless otherwise agreed, the right of withdrawal does not apply in the circumstances provided for by applicable law, including:

  • the supply of products made to the consumer’s specifications or which are clearly personalised;
  • the supply of newspapers, periodicals or magazines, with the exception of subscription contracts.

To facilitate the exercise of this right, Técnica Livraria provides an optional model withdrawal form. The consumer may use this form or submit any other unequivocal statement within the statutory period.
